1.General Information

Volkswagen India Private Limited ("VWIPL") offers Internet users the option of researching information via Volkswagen Media Services (www.volkswagen-media-services.in) subject to the terms of use set out below.

Journalists and media company personnel may also apply for accreditation to download material and information from the Volkswagen Media Services website.

All information and material provided on the Volkswagen Media Services website such as text, image, audio or video documents, is intended for personal information purposes only or, in the case of journalists and media company personnel, as a source for their own editorial reporting. This information and material is not intended for commercial use. Image, audio and video data may not be passed on to third parties. The plagiarism of the information provided at Volkswagen Media Services website is strictly prohibited.

2.Services

The contents of the Volkswagen Media Services website are tailored to the information requirements of journalists. Press releases, digitized brochures on various topics, cutaway drawings, image, audio and video documents, technical data sheets etc. are an integral part of Volkswagen Media Services. The data contained in the website refers to the Indian market. In case there is data manipulation of the information obtained from VWIPL’s media services in print and electronic media, VWIPL reserves its right to take appropriate legal action against an individual or legal entity for such a publication.

3.Data Protection

The data collected during the registration process serve to verify authorized access and to ensure unambiguous personal identification. The communication data serve postal or electronic communication in a business context and are not used for other purposes. 4.Precautionary Measures/Security

Journalists and media company personnel will be issued with a user ID and a password for downloading image, audio and video data from the Volkswagen Media Services website. The password must be kept secret to avoid abuse. In the event that journalists and media company personnel have reason to assume unauthorised parties have access to their password, they are requested to contact us by e-mail. A new user ID will be sent to you and you can set a new password. The old access will be blocked.

If you wish to send an e-mail direct from the Contact page of the Volkswagen Media Services website, it should be noted that such data is transmitted without encryption and that the confidentiality and integrity of the contents cannot be guaranteed.

5.Cookies

VWIPL uses cookies when you visit the Volkswagen Media Services website. You can decide on the use and scope of cookies yourself by adjusting your computer settings (generally in the Internet browser, e.g. Internet Explorer).

VWIPL assumes that you agree to the use of cookies if permitted by your browser.

6.Warranty

All the contents of the Volkswagen Media Services website have been meticulously researched and compiled, but the information may nevertheless contain errors or inaccuracies. VWIPL does not warrant for results that may be obtained from use of the information, in particular with regard to the correctness, topicality and completeness of such information, nor does VWIPL warrant that the quality of the information complies with the wishes and requirements of journalists.

7.Liability

VWIPL shall only be liable in cases of proven negligence and proven loss caused to an individual or legal entity on account of usage of information from the VWIPL’s media services website.

From a technical point of view, failure-free operation of the Volkswagen Media Services website is not possible. Failure may on occasion lead to delays, such as message transfer hold-ups. VWIPL shall not be liable for claims arising from the use or temporary unavailability of the Volkswagen Media Services website.

The Volkswagen Media Services website includes links to websites operated by third parties. VWIPL does not acquire ownership of the third-party sites accessed via links and is not responsible for their contents.

8.Permissible Use/Abuse

Regulations concerning copyright, names and brand names as well as other industrial property rights of VWIPL , Volkswagen Group companies and other third-party industrial property rights must be observed and respected when using the Volkswagen Media Services website. The source of any image, audio or video material made available to journalists and media company personnel by Volkswagen Media Services must always be stated. These web pages and these terms of use may not be interpreted as granting any kind of licence or other right to the industrial property rights of VWIPL.

By acknowledging these terms of use the user hereby undertakes to desist from any abusive use of Volkswagen Media Services, in particular not to bypass any security precautions protecting the information service, not to use any facilities or execute applications possibly or actually damaging the facilities or which may lead to the failure of Volkswagen Media Services, in particular by changing the physical or logical structure of the servers or network of VWIPL or its service providers or other networks, not to integrate the information service or any part thereof in other websites, whether private or commercial, nor to use Volkswagen Media Services for commercial purposes.

In the event of wrongful use, VWIPL reserves the right to block access to the protected pages of the Volkswagen Media Services website without notice.

9.Applicable Law

The use of the Volkswagen Media Services website and these terms of use shall be construed and interpreted in reference to Indian law.

10.Place of Jurisdiction

It is agreed by the subscriber to the information that the competent courts of law located at the City of Pune in India shall have of jurisdiction for any disputes arising out of or in connection with the use of the Volkswagen Media Services website.

11.Severability Clause

If any provision of these terms of use is held invalid, such invalidity shall not affect the other provisions of these terms of use which can be given effect without the invalid provision, and to this end the provisions of these terms of use are severable. In lieu thereof there shall be added a provision as similar in economic sense and purpose to such illegal, invalid and unenforceable provision as may be possible and be legal, valid and enforceable.
